Fundamentals of the Collective Bargaining Process

DESCRIPTION

This workshop is intended for excluded staff interested in the collective bargaining process or who may become involved in bargaining as a member of a bargaining committee in the future.

WORKSHOP GOAL

Participants will leave with an understanding of the collective bargaining process in the post-secondary sector.

LEARNING OUTCOMES

This course will cover the fundamentals of the collective bargaining process in the post-secondary context.

We will examine:

  1. The relevant provisions of the Labour Relations Code including the rights and duties of employers and unions, the general bargaining process, up to and including strikes or lock outs.
  2. Preparing for bargaining - developing proposals, researching bargaining issues, and issuing estoppel notices.
  3. The bargaining committee – who should be on a bargaining committee, and the roles of each member once bargaining commences.
  4. The bargaining process, including negotiating protocol agreements, exchanging initial proposal packages, progressing from housekeeping to monetary items, package bargaining, and ratification of an agreement.
  5. Understanding bargaining in our sector, including the role of government, PSEC, PSEA, common tables, and the coordination of bargaining in our sector; and
  6. What happens when the bargain becomes difficult - mediation, job action, strikes or lock outs, essential services, and returning to work.

Twyla has over 25 years of leadership, labour relations and consulting experience in the public and private sectors. She has extensive experience in preparing bargaining strategies and acting as a spokesperson for the employer. Twyla holds a Bachelor of Liberal Arts and Sciences, a Bachelor of Education, and a Master of Business Administration.

Chris is a senior labour relations and human resources professional with over 35 years of experience in both public and private sector settings providing strategic direction, achieving organizational objectives, and negotiating collective agreements. She has unique experience representing employers and unionized employees and acting as a negotiator on a sectoral basis for PSEA.

Linda Heska

Linda is a consultant, human resources professional, and a labour relations specialist. Linda has over thirty years of H.R. experience with twenty-plus years of leadership experience, primarily in unionized environments within the public sector.

A particular area of Linda’s expertise is grievance management, collective bargaining and labour management relations.

Linda holds a Master of Arts in Leadership from Royal Roads University and a Management Certificate, maj. Human Resources, from the British Columbia Institute of Technology.
